It depends on what your TOS is GC ;)
Most hosts have a different TOS so they wouldnt all be the same but i NEVER go into a clients account unless I have a report of something against TOS or I suspect it myself.
I also would go into their account to fix any problems but I would still ask them if its ok to do so first, its nothign to do with my TOS but its just something I always do as some clients wouldnt want you going into their account without permission and I dont mind asking as it is their account.

Your landlord wouldnt come into your house if you rented it and he had a key so I think of it in the same kind of way ;)
 
THey could, but most of the time they will look to see if there is any irregular activity before they go into the account to see if it really is illegal stuff.

But i asked my client first ;)

Hosts normally wouldnt go through accounts to check for warez/illegal files because it would usually take far too long depending on how many accounts there are.

You could do a search throughout the server but there are ways to get around that if anyone does have warez in their account so really its not worth it.
 
Yeah, huge useage of bandwidth which irregular could be related but also people would report it to the host.

I wouldnt go actively looking for warez, I think the host takes responsibility for the files once they start doing that so it just puts the host under pressure from the law, even if they are just trying to prevent and resolve any problems.
 
I think under the law something like that can happen if the host starts looking for the files, but if the host doesnt go seeking warez files then its down to the account holder, but it also has to do with the host's TOS.

I cant really remember what exactly the law is, but its better just to look if there is a reason to suspect it instead of checking all servers/accounts :)
 
It depends if the host has anything about warez in there TOS. and if it states that the host is not responsible for it but the client is.
 
It can be hard to detect warez especially if you sell dedicated hosting. You will find that most law agencies are ok if you act quickly

I never realised how hard it must be for a host. It must be one of the most taxing jobs there is. Act and you could get into trouble, dont act and you could get into trouble

Although most people that do warez related things probably own their own servers so people cant shut them down as easily.

Most data centers will unplug your server if you have warez on it!
 
I don't think they will check your server unless you are reported - and you will be soon - also using * alot * of bandwidth will sure make then check you :)
