Once I uploaded some files on my rented host server. Those are just some text files without extension but their names contained some copyright names like Adobe Photoshop, Illustrator. Those actually was some instructions about those programs I uploaded for some client. Host customer service I guess though those were actual applications and deleted all those files without noticing me. I was warned before my host account deletion not to do that again. I sent a few emails explaining to the idiots, but nothing.

Good thing I always keep multiple backups, so no problem there. But imagine the stupidity?!
 
I don't think hosts should delete or touch anything without contacting you first and at least inspecting the files. I hope you switched hosting services right away after that? Ridiculous.
 
Yep, that is just horrible service right there. A host is supposed to check the files to make sure before deleting. Also, the host is supposed to warn the client and have the client delete the files. If the client does not want to then the host can delete the files.

Like Chatterbox said, I hope you moved away from that host.
 
I have seen webhosts being awfully trigger happy about deletions sometimes, just because they see a certain name and then fear for the worst about it. Just mentioning the name 'Adobe Photoshop' doesn't mean you are pirating it, but try telling that to some of these hosts :(
 
Since we really have no idea what the actual files were I don't think anyone here can comment with any accuracy.

A host is "supposed" to make sure there is no illegal activity on their servers. They can warn the client or they may not. If a complaint comes from the public and the host determines the files to be against their TOS then there is no mandate to wait for the client to remove the files.

The host is fully within their rights to do so.
 
But the problem is that sometimes something really is not against TOS, but the host may see something and get the wrong idea about it. While I understand the need for being cautious, sometimes I just think it goes too far.
 
I have been doing this for awhile; however, I do not know of many hosting companies who sit and monitor uploaded content. It would make me believe that something you uploaded triggered a DMCA complaint.

Most hosts will provide you 24 hours to respond to the DMCA complaint before suspending your account.

Our policy was to give the client 24 hours. If the client did not respond we simply suspended the account. If the client then did not want to cooperate we simply terminated the account.

While it maybe within the hosting companies rights there is the opportunity for a client to bring a suite by deleting their content. It was easier to suspend and terminate then delete individual files.
 
Agree a host has the right to delete especially if it warranted a DMCA complaint. However it generally is a good rule of thumb to at least give the client some warning prior before taking action and give the client the ability to take care of any violations on their own. If they don't do it, as others said suspend then terminate.

If there was nothing wrong with the files, and you told your host this and they don't want to work with you then its best to move on.

I agree with these comments by Romes. Bad hosting service if its found to be that the files were infact your own files relating to how to use the software and you own the copyright, otherwise if you didnt and you were using someone elses content good on the host for taking quick, swift action.
 
From what's posted here, this sounds bad, but without both sides of the story, it's hard to place fault. Did you ever get a reply to your emails?
 
Thanks for the comments guys, but those were just some txt files that I sent to the client with my instructions for him. Nothing copyrighted for sure was in that files.
 
Well sense they where not copyrighted as you stated above why the heck would they delete them? That should be a red flag in your mind that somethings not 100% okay with this company. Have you even asked why this happened? I hate to bring this up but perhaps they have a security issue - maybe not a hacker but an old employee of theirs still has information and is messing with clients to hurt the company; anythings possible. Best of luck to you and I'm sorry to hear this happened to you. Not all web hosting companies are like this.
 
I typically don't touch files on a server unless its obvious infringement, or receive a DCMA complaint. Which you would get a legal notification to remove the content and 24 hours to do so. Policies should not alienate customers, and customers should keep their contact information with the host up to date to be informed of such issues when they arise.
 
I asked them immediately to restore my files from backups but they just replied couple of times that my account will be deleted if I upload those files again. I was furious!
 
Try resolving the issue with the host directly if they are providing any live chat service and clarify your problem to them. But the point is why do they even bother to delete the files without warning the costumers ??
