wow.. not a good situation at all. Putting software on a persons computer is also uncalled for. Granted, we do have some software that our users may install (automated backup software for cPanel etc), but there's no spyware associated with it. If they pulled something like that on me I'd be in court within minutes.

For such a small fee, I'd file a court case, contact the attorney general and various other agencies. If it was an out of state company, you can also file federal. It may be a little more difficult to show "intent" to defraud, but you'd have a fairly big leg to stand on if you wanted to persue it.

That seems awkward a host wont allow backups. They find all the reasons not to allow it too=( Better luck next time. Just out of curiosity, what panel did you use that the backup feature wasn't avail? You could of just went onto FTP and d/l everything, no?
