okay I just wanted to let everyone know my situation.

my dad was using these guy for his realtor website and I told him to cancel because I can give him free hosting etc.. Now I was trying to get a personel backup of his website and the guy that I talk to wouldn't allow it. here is the log: I am talking as my dad in the chat but he was right beside me the whole time.

Then he give me the running around of you have to access to the sever to get a back up. So I said can you make me a personel backup and put it on a cd and send it to me. He said no. I then ask if they have a TOS and they don't. There support isn't great all from what my dad told me and they don't have TOS. So to everyone out I wouldn't trust these guys at all plus they over charge for there services. my dad was paying $69 a month.

Now onto realtor.com this guys are the worse.
After that I ask my dad what else he pays for and he said realtor.com and then he said he doesn't get any business from them so he called them up to cancel his account. This is were it gets interesting.
Now when my dad ask them about them to termiate his account they said you have to pay 2-3 months cancellation fee. He said that his rep didn't say anything about. The guy then says it was a verbal agreement between you and the rep. Before all that the rep said he was on month-to-month contract. The guy who my dad talk to said you are on a yearly plan so that you would have to pay the cancellation fee I think. All of this
I am just remembering but I just wanted to let everyone about these shady companies.
 
That really sucks.

Have you tried contacting the consumer advocate in your state about either of these companies? They might be able to advise you if you have any options for ending dealings with either of these firms and getting what you want. (That host who's operating without a TOS...I don't know that I would feel comfortable doing that.)

Best of luck resolving both of these situations. (On a side note: has anyone read anything about the legality of these overexhorbitant "early cancellation fees" on rotating-service leases like cell phones, home internet connectivity (through Verizon), and companies pulling these "verbal agreements" like what was described above? I can -=almost=- understand asking for an additional 30 days' payment on some services...but 2-3 months' worth? That just seems wrong.

Maybe this latest economic shakeout will end the abusive cancellation fees.
 
It sounds like your father was really taken for a ride by these clowns. They sound like a new, and awfully unorganized hosting company, and the excuses the guy gave were absolutely pathetic. Thanks for telling us though, since we can at least try to avoid them :)
 
There was a big thing a few months ago about the early cancellation fees where you were able to get around that. I know that there was some stuff in California where it violated california state law when charging these fees etc.

Also, there was something about the contracts. Even if there was a minor change in a contract, then the contract was voided and you have 30 days to cancel the agreement. Check up on FCC on that.

Excessive cancellation fees are a joke! They shouldn't be allowed, and if taken to court, you can probably get out of it. Remember, it costs more money to defend than it does to file. Pay the $15 to file a lawsuit, and make the company defend their actions in civil court.
 
Lesli thanks for your information on telling the consumer advocate in your state. Its very sad when people take advantage of other people because they don't have the knowledge. I truly believe in what goes around comes around. Thank you everyone else for your comments. My dad in the process of getting everything resolved and in the mean time I am creating a different website for my dad.

Thats a really good idea but my dad will never do that. To him its a waste of time. I told him that was going to post this on the internet and he said don't. But now he is happy that I did. Thanks for your advice conor
 
Should never let a bad host push you around. Take them to court if they refuse to give you your files.
 
I understand holding backups becuase of non-payment, but holding backups becuase their either lazy, or just don't want too is just sad. That company won't last long with those kind of businesses standards.
 
The chat does not seem professional at all.
You should really take your business elsewhere where you will be treated with a lot more respect.
 
Yea in my situation it wouldn't be worth the time and money to do that. I have notice lately that a lot of internet companies are shady companies putting spyware on your computer and crap like that. Example: The website is called releventknowledge.com and the software is called the same thing. Some how it got on my computer and I couldn't get the dam thing off my computer and I try everything add/remove programs and it wasn't there. So I check the regedit and couldn't find it in there but I knew it had to be there. So I called the company and I guess comscore owns them. The first couple of calls I go straight to the voicemail. So I call back again and press 0 like 1 million times so I would talk to a human and then she transfer me to another voiceman and by this time I am piss off. So I call probably another 5 times and the woman wouldn't answer , so I kept calling knowing that she could hear me everytime and hopefully pissing her off because finally on the 7 time or some thing like that the lady final answer and then she said she was going to transfer me and again. I said no no I want to talk to your boss and not some dam voicemail. So I talk to another lady and I am asking how this software got my computer and I told her I didn't install it. So She first says maybe one of your other people who use your computer did. I said nope I the only one. AT this point I am piss off and have no respect for this company. I tell her you put this software on my computer through spyware . she didn't say anything for a couple of seconds and at that point I knew I was right even though I already knew that lol. she then tells me that I could of download a screen saver or something like that and it install the software. After that I told her your company is shady and other stuff I don't remember I was piss. After that she finally give's an email with software to rid of the dam thing.

STAY AWAY FROM COMSCORE and there other companies. Companies like them that give the internet a bad name.

I don't think its they didn't want to give your files back, they might have deleted your files on the server and they have no way of getting them back to you.

Most armature host remove clients data right away. some hosts keep data suspended on server got 1 year.
