While ICANN governs all .coms VeriSign is the contracted .com operator so court orders will go to VeriSign and not ICANN (Or maybe you could go to both?)

if you have a .com domain dispute, you are directed to contact ICANN, but then ICANN will tell you to use one of their agents to file the dispute and their agents charge an average $1,500 per dispute.
