Microsoft Windows Template, What's it worth?

I think this template is great for anything, I'm not the creator of this but I do hosting for the guy.

open up your internet explorer and go to www.csharpusa.com
press F11 to set IE full screen, right-click and auto-hide the top IE bar to make it complete full screen.

the template can also be a wrap for another website, for example:
if you go to
http://www.csharpusa.com/desktop.php?http://www.duoservers.us
you can view my website inside that template.

The guy told me he refused a $3,000 offer instantly and the template has never been sold to anyone.

You are partially right, but the guy told me those images are easily replacable and he said he's not scared of Microsoft due to the fact that Microsoft made a software called sharepoint and it was very simular in his concept, he made the concept of "surfing the web like using windows" back in 1998 and as you all know that Microsoft is the owner of Windows but they do not own the web/internet, he could have filed a lawsuit against Microsoft for stealing his idea and intelluctual property because sharepoint was made in year 2000 and his concept was made in 1998 but he did not get copyrighted on his concept back in 1998, so that's the story, lol so I'm offering him free web hosting on my server.
 
As far as I know, that is nothing like sharepoint. Sharepoint is just a content management system/file sharing system. (Played around with 2002 version). He could not sue Microsoft at all, he's just kidding himself. Basically every image used is either property of Microsoft or are trademarks (i.e Longhorn). Also, Microsoft has very powerful lawyers and would end up taking everything he owns. So I would say that its worth $0. Sorry for being so harsh, but this warrants a wakeup call.

You know sharepoint is like windows interface but it's made in web language right? that alone is enough evidence, and everyone probably realized that Microsoft is starting to use web language for their windows software, the upcoming visual studio .net 2005's installer is made in web language and also Microsoft Platform SDK February 2003 Build 3790.0 is made in web language.

Sharepoint is a portal for messages, files, etc. It is not a windows interface. Just because someone may have thought of something first, doesn't give them the legal rights to sue over it. Especially if you are using the other companies images. Its common sense.

I have said it before and I'll say it again, those images are easily replaceable, I have asked my friend who is a lawyer, he told me basically the samething, he said if that idea was copyrighted, he could do it easily, you know ebay lost a lawsuit too about using another guy's idea? go to google and search for intellectual property and read about it.

God... why you keep arguing over nothing? it doesn't matter if microsoft steal it or not, it's the LAW, if someone made something unique and get copyrighted, it's their own intellectual property, that's the end of it, the judge doesn't care if microsoft steal the idea or not, they only care about "WHO MADE IT FIRST".
 
I'm not arguing with you. I'm trying to understand your logic and clarify mine. Did he indeed copyright this? It doesn't matter who made it first. The content on the page is not his, it is Microsoft's (even if the images are replaceable, which would defeat the purpose)
 
Ok, I want to stop this also, if you want to we can discuss about this on instant messenger, what you saw was a 'WEBSITE", not Microsoft Windows which is an Operating System for PC, it's 2 completely different thing, there's no violation of any sort, images are replaceable, but the design is for a website, not an operating system for PC, let's end the discussion and talk more on instant messenger :)
 
Thats fine. I just was hoping that you would understand my point of view. I'm not here to give you or anybody a hard time, just to share whatever knowledge I have and offer my opinions.
 
Yea, I understand, but your opinions are harsh and unthoughtful, it almost feel like you are a Microsoft employee trying to protect Microsoft LOL =)
 
The guy should have taken the 3 grand.
This template is worth exactly ZERO dollars. It is a copyright infringement. Even if you change the images why would anyone want the template?

LOL, you are funny, your website http://www.eskillet.com/forum/ have images from Microsoft Windows(those forum catergory image), I can dig out at least few thousand websites out there on the net with images like microsoft windows, you think microsoft care? no they don't, it's not a big deal since images have simularity, even human have look-alike, why can't images? lol

I'm starting to feel like this place is a "Forum of Jealousy", I smell heavy jealousy on this forum, maybe because some of you make templates for living and try to talk your competitors down.

I don't see any Microsoft images on his forums. Anyway, you are correct that Microsoft doesn't care in those situations. But when they start to care is when somebody tries to release a clone (even web based) of their software with the intent of making money off of it.

We're not telling you these things out of jealousy. HD is not a forum of jealousy. We are a community full of information, friendly people, and respect for each other. We are simply providing our opinions as well as facts of the legal system.

This is a forum for professionals. Try a teen forum somewhere.
 
Ya but, you think Blue know anything about Laws? There are people who knows and there are people who don't and just want to start flaming, even if he's not coming from jealousy, it still feels like it, you know what i'm saying?

And now he calls me a scammer, is that's how professionals respect others? He calls himself professional, does he act like one? Absolute NO!

I wanted to stop that discussion but Blue comes in and started flaming and calls me a scammer, this is very sad...

I've been reading Blue's posts for almost a year now and you have to trust me when I say that he know's what he's talking about. He is one of the most experienced in the industry and demonstrates this time and time again. He's not as dumb as you think.
 
I didn't think he's dumb, but I don't think he understand US LAWS very well, what's up with him now??? as you can see, I didn't disrespect him or anything, he just comes in and saying this and that and call me scammer with absolutely no evidence, everyone know "words of no proof" == "lies".

I really don't want to make this an ugly ending, I think we should all stop discussing this, if you want to call me names or whatever, do it in PM or instant messenger.
