Lawsuit? No Lawsuit?

It is definitely an interesting new outlet, worth watching.

Can't comment on the legal matters, but I am sure people behind the venture are getting the advice before spending money on development.

The complication I see is the actual verification of the posted owed amount. How are they planning on checking that?

Businesses will also be able to settle disputes directly through the system and even clear up past due debts.
Perhaps the most intriguing feature of all!
 
Interesting, here in Sweden such lists exists already but the other way around, when consumers fail to get their moneys worth or dispute bills and settlement fails.. The consumer then turns to a sort of county consumer representative (not court) who lets both parts be heard, then making a settlement recommendation.. Businesses failing to follow the recommendation end up in these lists..

Naturally, being on the list is bad for business..
 
In the U.S. where this is being developed, we have privacy laws that shield from this. This is for word what it says on thier site:

"We're not lawyers, just a bunch of people that haven't been paid for our hard work. Please don't sue us, we don't have any money"

Have to love that line :). Doesn't mean they won't get sued anyway.
 
I love the fact they have to bag for someone not to sue them. Steve, would you do business with someone who was willing to post their customers information online?
 
This is definitely information disclosure. If you go to court however the information and findings in the case are published publicly. At that point I wouldn't see a reason not to be posted on the list since the state/county is already posting this information.

For me, I've always used a collection agency or a court order to settle disputes. I'm not at all impressed with a site that asks not to be sued, offers to host information publicly and then states they are not lawyers. It's a court case waiting to happen, but under what terms would be the question. It's not slander (since it's true) so at best it's Libel.

I'm sure even just a letter to these guys with the POTENTIAL threat of legal action would encourage them to remove the entire site :)

What happens when a business screws up for the first time and posts the wrong customer information? From their description this is suppose to be used prior to court or collections. A court room is a justice type scenario. These are public sector trying to post confidential information. I think something is wrong with it.
 
Oh I agree, I don't think this information should be posted until settled in court, arbitration or whatever.

Anyone can post anything - it's why some of those "report a spammer" or "ips to block" type sites can be problems as often there's no validation taken on the part of the site owners. They just claim to "provide a medium for discussion" and wash their hands of it.
