I just had a client tell me today they ran into an issue when going to sell one of their domains. The client came to me with this domain already but failed to notice he does not really own it. I was hoping someone here has ran into similar and could find some good references on this so I could pass it along to him. Thanks in advance, its been a crazy week....is it Friday yet?
 
They don't own it or the domain is in the name of the host?

If the domain was provided free with hosting then the assumption is that the contract has to be honored before the domain becomes property of the client.

If that contract was fulfilled then the client should request that the host change the domain ownership information to his/her name.
 
Or perhaps it was in the terms of service that the domain always remained in the possesion of the company who provided the hosting services? Maybe your client should examine his previous contract or any information that he has a little more closely.

try having him google free domain name or registration see what he comes up with i mean my domain is free and registered to me .co.cc
