Why are terms never read?

You know I just have to ask this question.
Why do people that want to run IRC Bots or those that send out spam, why do they always want to sign up on servers or with companies that don't allow it?

I mean there are plenty of hosts out there that cater to IRC customers and of course you can send spam from practically any third world nation so why not just host with those companies?

Is part of the thrill in the chase so to speak, living on the edge?

I have been pretty fortunate with my business so far (knock wood) but you hear about so many that are just being taken advantage of and I just don't see why they do it.

Is it just that they don't read the terms, or they just don't care?
 
Well maybe it's because I am some old fogy, but that is one of the first pages I go to on a webpage that I am considering doing business with, and if I do business with that company I go and print them off and put them in a notebook.

Just seems like a lot of hassle would be eliminated if they would just read them. Maybe website should start making that the main page and they can't go forward until they read it. :)
 
I'm another one of the few, the proud, the people who reads contracts before she signs them. I was speaking with a family member the other day, and the reasons for not reading the TOS were (specifically on websites):

* printed in tiny little print - difficult to read
* sometimes printed in those *#()%! textarea fields - so can't print out and read
* text is difficult to understand
* most text says the same thing, so she has almost developed a "if you've read one, you've read them all" mentality

I worked very carefully to make my client agreement easy to understand, but at the same time it's a tight contract.
 
Yes I feel the same way Lesli, though I tend to have the small print. :) I am going to set mine on an additional printer friendly page as well since it is so important to me that they have a copy. I had a lawyer look mine over when I first drafted mine and tried to keep it as friendly as possible. Now I am not near a lawyer and I am trying to draft a section on prohibiting sites that promote hate and terrorism without stepping on Freedom of speech and it is killing me.
 
It's enough to drive you insane, isn't it? :D

Do you have email contact with a lawyer? Or do you have a lawyer whom you regularly use?
 
We had one we used regularly before our last move, now we just have to find a new one since we will be moving to Arizona, I plan on getting the business license, accountant and lawyer all setup hopefully by August, we are buying a home as well so we have a lot of work ahead of us once we get there and a lot of work preparing things before the actual move itself. All of it is enough to drive me batty some days.
 
People do not like to read the TOS because two main reasons, it is way too big usually, and often written in the smallest font they can find it seems :P
 
My other (least-) favorite trick:

Have the client agreement in microfont, medium- or light-grey text, on a white background.

The other day I received some HelpDesk Tickets (like 3) two wanted to run IRC, and the other wanted to mass mail when on our TOS it says plainly "NO" :rolleyes:

Oh, I think I have a fairly good idea.

I have the feeling that the parents of these people were the kind who didn't discipline their children because they didn't want to stifle their creativity.

"Look, lady, if you don't stifle your precious child's creativity just a few decibel levels, me and my friend Mr. Duct Tape are going to restrain a lot more than just their creativity..."

I don't necessarily believe in canned support ticket answers, but I do have a pre-made response for any extremely foolish or thickheaded questions: the link to the client agreement.
